Terms of Service

1. Agreement and parties
These Terms of Service (“Terms”) are a legally binding agreement between you (“Customer”, “you”) and SAPTSEC LTD, registered in England & Wales (company no. 10884563), with its registered office at 124 City Road, London, England, EC1V 2NX (“we”, “us”, “xClarion”).
By creating an account or using the xClarion service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organisation, you represent that you have the authority to bind that organisation.
2. Service description
xClarion is a cloud-hosted incident communications platform that uses AI to help IT teams and Managed Service Providers draft, review, and distribute incident status updates across multiple audiences. The service includes webhook ingestion, AI-assisted draft generation, multi-audience communications, and an audit trail.
3. Accounts and access
- You must provide a valid email address and maintain the security of your account credentials.
- You are responsible for all activity under your account.
- Workspace owners may invite additional users and assign roles (admin, member). You are responsible for the actions of users you invite.
- We may suspend or terminate accounts that violate these Terms or are used for unlawful purposes.
4. Acceptable use
You agree not to:
- Use the service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorised access to other accounts, workspaces, or the underlying infrastructure.
- Reverse-engineer, decompile, or disassemble any part of the service.
- Transmit malware, spam, or content designed to exploit the AI system (prompt injection, jailbreaking).
- Exceed reasonable usage limits or abuse rate-limited endpoints.
5. Your data
You retain all ownership and intellectual property rights in the data you submit to xClarion (“Customer Data”), including incident details, timeline events, and communications content.
You grant us a limited licence to process Customer Data solely to operate and improve the service, including sending it to our AI sub-processor (Anthropic) for draft generation. We do not use Customer Data for advertising, and Anthropic does not use it for model training.

6. AI-generated content
Communications drafts generated by xClarion are produced by an AI model and are provided as suggestions only. You are responsible for reviewing, editing, and approving all AI-generated content before distribution. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated drafts.
7. Service availability
We aim to provide high availability but do not guarantee uninterrupted service. The service includes degraded-mode behaviour: if the AI sub-processor is unavailable, placeholder drafts are generated that you can edit manually. Scheduled maintenance will be communicated in advance where practicable.
8. Fees and billing
xClarion offers free and paid plans as described on our pricing page. Paid plans are billed in advance on a monthly or annual basis. All fees are exclusive of applicable taxes unless stated otherwise. We may change pricing with 30 days' notice; continued use after the notice period constitutes acceptance.
9. Term and termination
- These Terms remain in effect while you have an active account.
- You may terminate your account at any time by contacting support@xclarion.com or using the account deletion feature.
- We may terminate or suspend your account for material breach of these Terms, with reasonable notice where practicable.
- On termination, your data will be retained for 30 days to allow export, then permanently deleted in accordance with our retention policy.
10. Limitation of liability
To the maximum extent permitted by law, our total aggregate liability under these Terms shall not exceed the fees paid by you in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
11. Disclaimer of warranties
The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated content will be error-free or suitable for any specific purpose.
12. Indemnification
You agree to indemnify and hold harmless SAPTSEC Ltd, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your distribution of AI-generated content without adequate review.
13. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via the email address associated with your account at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
